What the National Credit Act caps
South African credit pricing is regulated rather than free. The NCA sets a maximum interest rate for unsecured credit, expressed as a formula linked to the repo rate, and separately caps the initiation fee and the monthly service fee. Those caps are the reason a legitimate lender's quote falls within a predictable band, and the reason an offer far outside it is a warning sign rather than a bargain.
The fees matter as much as the rate. An initiation fee is typically added to the loan rather than paid upfront, so you borrow it and pay interest on it for the full term. A monthly service fee sits outside the interest calculation entirely and is easy to omit when comparing quotes — which is why the total amount repayable is the only figure that compares two offers honestly.
Affordability assessment is a legal requirement
The Act obliges a credit provider to assess affordability before lending, examining actual income and expenses rather than applying a ratio. Reckless-lending provisions mean an agreement granted without a proper assessment can be set aside or suspended by a court. In practice this means a lender will want payslips and bank statements, and an approval will often be lower than a simple debt-to-income calculation suggests.
Credit life insurance
Credit life cover is commonly required and is capped by regulation, but you are entitled to substitute your own policy that meets the lender's requirements rather than taking theirs. Many borrowers do not know this, and the difference over a multi-year loan is meaningful. Ask what the cover costs as a separate line before agreeing to it.
Rights worth knowing
You may settle a credit agreement early, and for smaller agreements the settlement amount cannot include an early-termination penalty. You are entitled to a quotation valid for five business days, which gives you time to compare rather than sign in the branch. And you are entitled to one free credit report a year from each registered bureau — worth pulling before applying, since the rate you are offered follows the record.

How high can the rate legally go?
The National Credit Act caps unsecured personal-loan interest — the ceiling is linked to the repo rate (repo × 2.2 + 20% at the time of writing), so it moves with the Reserve Bank. Enter the rate in your quote; a reputable lender will show it plus the initiation fee and monthly service fee.
What about fees on top?
